Social Security Disability Applications and Claim Denials – Your Rights

Oct 14, 2013 | General

To apply for Social Security Disability or SSI, the application process is quite similar. To begin, you will need to apply online, contact your local Social Security Office or call the Social Security Administration. To be eligible for Social Security Disability you will need to be “disabled” by the strict definitions set by the Social Security Administration. According to their website, you may be considered disabled by Social Security standards if:

  • You cannot do work that you did before;
  • Social Security decides that you cannot adjust to other work because of your medical condition(s); and
  • Your disability has lasted or is expected to last for at least one year or to result in death.

What Happens if I am Denied?

When making a determination, the Social Security Administration looks at whether you are capable of doing a job, not if they will or will not hire you.  Over half of all Social Security and Disability claims are denied the first time. When this happens, most claims will need to go before an ALJ or an administrative law judge for appeal. During this process, you will be able to directly communicate your claim and why you believe you should be receiving benefits based on your specific disability and circumstances. While many claims will now be approved, if yours is not, that is not necessarily the end. You may still choose to appeal the decision including appealing to the Social Security Appeals Council or even a Federal Court. Note: Each of the processes is allowed but will all have specific time restraints making it important to have assistance when proceeding further with your claim.
